Uleses’ diverse practice provides for a broad range of intellectual property advisory and litigation services, including domestic and foreign patent, trademark, copyright, trade dress, entertainment and new media, and publicity rights prosecution and counseling.
He performs overall strategic advisory services, to include patent non-infringement and validity analyses and opinions; trademark and product clearance and business methodology; intellectual property transactions and due diligence; acquisition and development of intellectual property; patent and trademark prosecution before the US Patent and Trademark Office; domain name disputes; patent and trademark licensing; high-tech transactional consultation, information technology licensing and outsourcing; and general intellectual property enforcement and litigation for various corporations, public entities and associations, as well as religious and non-profit organizations.
In connection with his transactional practice, Uleses has significant experience drafting and negotiating a wide variety of agreements that touch on all aspects of intellectual property rights, including ownership, licensing, confidentiality, liability, manufacturing, and open source issues. He is experienced in drafting a broad spectrum of agreements, including technology transfer agreements, technology license agreements, patent and trademark license agreements, joint development agreements, professional service agreements, ERP and implementation agreements, statements of work, service level agreements, consulting agreements, non-disclosure/confidentiality agreements, software development and licensing agreements, website development and hosting agreements, term sheets, and letters of intent.
He counsels entertainment and new media clientele on both transactional and content aspects of music, television and radio broadcasting, publishing, photography, content licensing, celebrity endorsements, sports and sponsorship of live sporting events, online entertainment and other entertainment industry matters.
Uleses’ litigation experience spans a wide array of technologies and industries, including medical devices, imaging and inspection devices, telecommunications, signal processing, automotive, sports equipment, toys and games, online media, music, video, television, broadcasting, audio and digital electronics, consumer products, and retail merchandise.
Uleses’ more notable representations include having served as international counsel for the 2007 Special Olympics World Summer Games held in Shanghai, People’s Republic of China; advising on the evaluation of products and packaging designs relating to trademark, trade dress, copyright, and patent issues for one of the world’s largest retailers and a leading audio and electronics manufacturer; and serving as counsel to Grammy-award winning songwriters and music producers.
He regularly lectures on a variety of topics in the entertainment, new media, intellectual property and technology areas, having included speaking engagements at such annual events as the National Society of Black Engineers Annual Convention, the National Bar Association’s Annual Convention and Annual Corporate Counsel Conference, INTA Trademark Administrators Conference, and the State Bar of California’s Annual Meeting.
Uleses’ prior experience includes multiple associate roles in such firms as Loeb & Loeb LLP (Los Angeles), Foley & Lardner LLP (Los Angeles) and Christie, Parker & Hale LLP (Pasadena).
He earned a B.S. in mechanical engineering from Purdue University, and an M.S. in aerospace engineering from the Georgia Institute of Technology. He received his J.D. from Loyola Law School, where he served as executive editor of the Loyola Law Review.
